A Scarsdale Police Department sergeant conducting DWI patrol shortly after midnight on Friday, June 15, stopped Elmsford resident Jose Jesus Mojica, 42, on Fenimore Road, near the intersection of Walworth Avenue, after he allegedly was spotted swerving over paving markings in the roadway.
Upon making contact with Mojica during the subsequent traffic stop, the responding officer reported that Mojica “had a strong odor of alcoholic beverage emanating from his breath, and his eyes appeared glassy and bloodshot.” When asked when he had his last drink, Mojica responded that it was “after work,” though police found three Tecate beer cans behind the passenger seat, one of which was open and approximately three-quarters empty.
Mojica proceeded to fail multiple Standardized Field Sobriety Tests and a breathalyzer found that he had a blood alcohol content of .133 percent. He was arrested at the scene and charged with misdemeanor counts of driving while intoxicated and operating a motor vehicle with a blood alcohol content greater than .08 percent.
Following arraignment, Mojica was released on $200 cash bail, which was paid by his nephew. Mojica is due back in Scarsdale Village Court on Wednesday, June 20 to answer the charges.
